Introduction

Interpretation of the core content of the standard

As an important technical specification in the field of judicial identification of environmental damage, this standard mainly solves professional and technical problems in cases of destruction of cultivated land and forest land. Its technical framework includes three core modules:

ModuleTechnical requirementsLegal basis
Entrustment acceptance 7 types of basic materials + qualification review are required Ministry of Justice Order No. 107
Identification procedure 4-stage working method + 5 sampling schemes HJ/T 166+NY/T 395
Opinion formation 5 types of severe damage judgment standards GB 15618+GB 36600

Analysis of key technical points

1. Special requirements for on-site investigation

The standard requires that more than two judicial appraisers jointly conduct the investigation, and three parties must witness it (the client + the party concerned). The investigation must cover 7 types of key information sources, including historical archives verification of the land administration department and on-site interviews with local people.

2. Innovative sampling point distribution method

Differentiated schemes are adopted for different types of damage:

  • Physical damage:Zigzag/plum blossom-shaped distribution, ≥3 sampling points in a unit
  • Pollution damage:Establish a three-dimensional pollution plume model according to HJ 25.1
  • Biological damage:A customized ecosystem damage assessment scheme is required

Suggestions for the implementation of the standard

1. Capacity building of appraisal institutions

It is recommended to establish a four-dimensional capability matrix:

  1. Surveying and mapping qualification (at least Class C)
  2. CMA certification and testing items cover all indicators of GB 15618
  3. GIS spatial analysis system
  4. Professional team for ecological risk assessment

2. : Key points for building a chain of evidence

A three-in-one evidence package should be formed:

  • Spatial evidence: remote sensing images + on-site mapping data
  • Material evidence: soil profile specimens + laboratory test reports
  • Related evidence: land use historical archives + witness testimony

Typical case analysis

Case: Identification of forest damage caused by illegal mining

A mining area violated the Forest Law and mined, resulting in the complete stripping of the topsoil of 12 acres of ecological public welfare forest. Identification agency:

  1. Using UAV oblique photography to build a three-dimensional model
  2. Six profile samples were collected using the plum blossom pattern method
  3. Soil organic matter content was tested to be less than 0.5% (control point 3.2%)
  4. The destruction was determined by citing the judicial interpretation of forest land by the Supreme People's Court
