Chapter I General Provisions

Article 1 This rule was formulated according to the relevant regulations of "Regulations on Safety Supervision for Special Equipment" and "Decision of the State Council on Establishing Administrative Licenses for the Administrative Examination and Approval Items Really Necessary to be Retained" in order to strengthen the safety supervision of pressure vessel and pressure pipe design organization (hereinafter referred to as design organization) and assure the design quality of pressure vessel and pressure pipe.
Article 2 this rule is applicable to the pressure vessel and pressure pipe design in the scope of those specified in "Regulations on Safety Supervision for Special Equipment".
Article 3 See Annex A and Annex B for the division of design license type and level of pressure vessel and pressure pipe design.
Article 4 The pressure vessel and pressure pipe design (hereinafter referred to as design) must be carried out by the pressure vessel and pressure pipe design organization (hereinafter referred to as design organization) who has obtained the "Design License of Special Equipment" (hereinafter referred to as "Design License") issued by the General Administration of Quality Supervision, Inspection and Quarantine (hereinafter referred to as General Administration of Quality Supervision, Inspection and Quarantine of the People's Republic of China). After obtaining the design license, the design organization may engage the design work in allowable scope over the whole country. The effective period of design license is four years. If the design organization continues to engage the design work after the expiration, they shall transact the license change procedure according to the relevant regulations of this regulation; without transacting or changing license without approval, the design organization shall not engage the design work after the expiration of design license.
The design organization shall be responsible for the quality of design documents. The design organization shall meet the relevant national safety technology regulations and standard requirements during designing products (system); and also shall take full consideration of production energy utilization and system energy-saving in order to improve energy efficiency.
Article 5 The design license shall be respectively examined and approved by General Administration of Quality Supervision, Inspection and Quarantine of the People's Republic of China and provincial quality and technical supervision department according to the principle of administration by different levels.
The General Administration of Quality Supervision, Inspection and Quarantine of the People's Republic of China is responsible for receiving, examining and approving the pressure vessel design organizations of Level A, Level C and Level SAD; and the provincial quality and technical supervision department is responsible for Level D.
