Analysis of the core terminology of the standard

Practical Calculation of Laying and Unloading Time

Two main calculation methods specified in Chapter 6 of the Standard:

  1. Daily Per Hatch Method: calculated according to the formula cargo volume/(daily loading and unloading rate × number of hatches), double hatches are calculated according to the number of operable surfaces
  2. Daily Per Working Hatch Method: based on the maximum cargo hold cargo capacity, the calculation formula is maximum cargo hold capacity/(daily loading and unloading rate per hatch × number of service hatches)

Demurrage and Despatch Mechanism

Typical case: A voyage charter contract stipulates that "dispatch is calculated based on the total time saved" (7.4). The vessel completes unloading 3 days in advance, one of which is a holiday. Then the dispatch fee should be calculated based on the full 3 days, which is different from the deduction method of "calculated based on the working time saved" (7.3).

Suggestions for the implementation of the standard

  1. Explicitly adopt the definitions of terms in this standard during the contract signing stage, and avoid using unquantified expressions such as "sunny working day"
  2. The conditions for submitting the "Notice of Readiness for Loading and Unloading" (2.6) should stipulate the specific port anchorage range
  3. It is recommended to add a "demurrage limit clause" and set up a penalty mechanism with reference to Article 7 of the model in Appendix A
  4. When adopting the "combined calculation of loading and unloading time" (6.4), the adjustment rules must be agreed upon simultaneously

Comparison between the old and new standards

Compared with the 1980 version, this standard has the following major improvements:

  • Add a clear definition of "ship passing quarantine" (3.3) to resolve health quarantine disputes
  • Detailed 6 methods of expressing loading and unloading time (Chapter 4), especially the weather impact clause
  • Introduced the "unless used" (5.6) clause to regulate the time calculation for operations during the excluded period
